1. Agreement
These Terms of Use apply to Smarter, including our mobile apps, website, account features, support tools, and related services. By using Smarter, you agree to these terms. If you do not agree, do not use Smarter.
2. What Smarter Does
Smarter is a driver assistant for people who use rideshare, delivery, and other gig work apps. It can help you review offers, manage settings, track shifts, and understand your work activity. Smarter does not guarantee that you will receive, accept, complete, or earn from any particular offer.
3. Independent Tool
Smarter is independent and is not affiliated with, endorsed by, sponsored by, or controlled by Uber, Lyft, DoorDash, Hopp, or any other gig platform. Names, logos, and trademarks belong to their respective owners.
4. No Gig App Credentials Required
Smarter does not require your gig platform email or password. You are responsible for keeping your Smarter account and device secure, and for keeping your gig platform accounts secure inside those platforms' official apps and services.
5. Safe and Lawful Use
You are responsible for using Smarter safely and legally. Do not interact with your device in an unsafe way while driving. You are responsible for following traffic laws, platform rules, employment or contractor obligations, insurance requirements, and any other rules that apply to your work.
6. Accounts and Subscriptions
Some Smarter features may require an account, an active trial, or a paid subscription. Purchases are primarily handled through Google Play on Android and the Apple App Store on iPhone. Optional web checkout may be processed by Stripe. We do not collect or store your full payment card number.
Billing, cancellation, renewal, refund, and chargeback rules may depend on the platform or payment provider you used. Manage App Store purchases through Apple, Google Play purchases through Google, and Stripe web subscriptions through the available Stripe billing tools or Smarter support.
7. Local Data and Optional Backup
Offer history, earnings records, trip details, and shift history are stored locally on your device by default. You are responsible for keeping your device and local exports/backups secure. If you choose to use online profile or settings backup, Smarter may store the settings needed to provide that backup.
8. Acceptable Use
You may not misuse Smarter, interfere with its operation, attempt unauthorized access, reverse engineer the service where prohibited by law, bypass subscription controls, abuse trials or referrals, submit false information, or use Smarter to violate the rights of others.
9. Availability and Changes
We may update, suspend, remove, or change Smarter features at any time. The app may not always be available, accurate, compatible with every device, or compatible with every third-party app or platform change.
10. Disclaimers
Smarter is provided "as is" and "as available." To the maximum extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, uninterrupted operation, and error-free performance.
Smarter is not financial, tax, legal, employment, safety, or insurance advice. Any estimates, metrics, automation, calculations, or recommendations are tools to support your own judgment.
11. Limitation of Liability
To the maximum extent allowed by law, Smarter and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost income, lost profits, lost data, missed offers, account issues with third-party platforms, device issues, or business interruption.
12. Termination
We may suspend or terminate access to Smarter if we believe you violated these terms, created risk, abused the service, or used Smarter unlawfully. You may stop using Smarter at any time.
13. Updates to These Terms
We may update these terms occasionally. When we do, we will post the updated version here and update the date above. Continued use of Smarter after changes means you accept the updated terms.
